TELTECH ADVANCED PHONE SYSTEMS CORP., hereinafter referred to as the “Company”; and THE USER, who has signed up for the service provided by the Company (hereinafter referred to as the “User”). WHEREAS, the User wishes to use the Company’s outbound call termination service (hereinafter referred to as the “Service”) under the terms and conditions herein.
The User agrees to:
The User acknowledges that they are solely responsible for all content and activity related to the use of the Service.
The User agrees to only initiate outbound calls to individuals or entities who have expressly requested or consented to such calls, in compliance with the laws of the United States, Israel, and any other applicable jurisdictions.
The User shall not make any calls to numbers included on any "Do Not Call" list in the relevant jurisdictions.
The User will not engage in any activities that involve short-duration calls or "call spamming."
The Company reserves the right to change and/or update the service rates and prices from time to time without prior notice.
The Company reserves the right to terminate or suspend the User’s account immediately and without explanation upon any violation or suspected violation of this Agreement. In the event of a violation, the User shall be liable for a fine of $5,000 per violation.
The User shall be fully responsible and liable for all legal costs and damages resulting from any violations of this Agreement, including potential lawsuits. The Company has the right to defend itself at the User's expense and later claim these costs from the User.
The User agrees to defend, indemnify, and hold harmless the Company, its affiliates, and their respective directors, officers, employees, and agents from and against all claims and expenses, including legal fees, arising out of or related to any activity by the User in connection with the use of the Service.
This Agreement shall be governed by and interpreted in accordance with the laws of the United States and Israel, without regard to its conflict of law provisions. The User agrees to adhere to all local, state, national, and international laws and regulations applicable to the use of the Service.
